Hello, and thanks for stopping by!

My name is Fergus, and I am a photographer and videographer based in Croydon, Surrey. My wife Sian and I love to shoot weddings and all things family, as well as events, products and advertisements. As long as my camera is involved I am in my element!

We offer photo and video shoots in Surrey, Kent, London and the South East, and often travel across the UK (and abroad) too. We have been lucky enough to have filmed and photographed weddings, families and hotels all over the world over the years, and permanently moved back to the UK in 2013.

My favourite images are natural, relaxed and allow each couple’s personalities to shine through. Many of our couples tell us that they hate having their photo taken or aren’t photogenic, but love beautiful wedding photography – it’s our job to make sure that you are having so much fun that all those worries melt away!

Your wedding photographer and their team will spend a lot of time with you on your big day, so it is very important that you meet up beforehand for an informal chat and get to know each other a bit better. I love to do an engagement shoot with my couples so we can talk about any questions you might have, how you met, the weather…and get some more gorgeous photos of course!

Our Booking Terms and Conditions

DEFINITIONS

The Photographer refers to Fergus Ford Photography.

The Client is the person or organisation to whom the invoice is addressed.

COPYRIGHT
The Photographer retains the entire copyright of the images/video at all times, throughout the world unless specific agreements for copyright purchase by the client are agreed in writing.

USE
The License to Use comes into effect from the date of payment of the relevant invoice(s).

IMAGE LISENCING AGREEMENT

The owner (The Photographer) of the copyrighted photograph(s)/video(s) being purchased, hereby grants you (The Client) the perpetual right to use, reproduce, and distribute the copyrighted Work.

EXCLUSIVITY
The photographer’s standard Licence to Use gives exclusivity on the images/video to the Client.

The Photographer retains the right to use the photographs for the purpose of promotion and marketing of her business under all licensing situations unless special circumstances apply or specific stipulations are made in writing to the photographer.

CLIENT CONFIDENTIALITY
The photographer will keep confidential and will not disclose to any third parties or make use of material or information communicated to him/her in confidence for the purposes of the photography, save as may be reasonably necessary to enable the Photographer to carry out their obligations in relation to the commission.

PRIVACY
The photographer will only collect and otherwise access information you voluntarily provide via email or through other direct contact.

INDEMNITY
It is the client who must satisfy himself/herself that all necessary rights, model releases, clearances or consents which may be required for reproduction of people, places or items depicted within any works are obtained. It is acknowledged that the Photographer gives no warranty or undertaking that any such rights, releases or consents are or will be obtained whether in relation to the use of names, people, trademarks, registered or copyright designs or Works of art depicted in any picture.  The Photographer shall only be responsible for obtaining such clearances if this has been expressly agreed in writing before the shoot. In all other cases the Client shall indemnify the Photographer against all expenses, damages, claims and legal costs arising out of any failure to obtain such clearances. The Photographer will not be liable for any loss or damage, for any consequential loss of profit or income however caused.

PAYMENT
Where the client and photographer agree a day rate payment, this fee shall be paid in full at least one week prior to the shoot date. No date will be reserved by the photographer until this payment is received in full.

EXPENSES
Where extra expenses or time are incurred by the Photographer as a result of alterations to the original brief by the Client, or otherwise. The Client shall give approval to and be liable to such extra expenses or fees, in addition to the fees and expenses shown on the Estimate as having been agreed or estimated.

PROCESSING AND RETOUCH EXPENSES
Shoot fees include standard post processing which equates to basic editing steps e.g. colour balancing, cropping, contrast boosting, exposure amends to match finished images in with brand identity.  Specialist photoshop work including cosmetic retouching is charged at £60 per hour.  Video shoot fees include standard post processing as above, and up to 3 (three) versions of the edited video; the first edit, a second edit with amendments provided by the client, and a final third video if any further amendments are required. If additional filming is required outside of the original brief, and/or if additional edits are required outside of the above parameters are subject to additional fees. Availability for re-shoots/edits cannot be guaranteed and must be at a time and date as agreed with the Photographer.

CANCELLATION & POSTPONEMENT
A booking is considered firm as from the date of Payment of invoice. The Photographer will always try and accommodate an alternative date if a shoot needs to be postponed due to ill health or emergency.

Once a client has made a booking for a specific time and date, if it is subsequently cancelled, a cancellation fee will be charged to the client according to the following schedule: when a client cancels a booking within 4 weeks of any confirmed date, a fee of 50% of the booked time rate will be charged. When a client cancels within 2 weeks of any confirmed date a fee of 100% of the booked time rate will be charged.

FORCE MAJEURE
The Photographer may cancel this Agreement at any time prior to the confirmed date due to unforeseeable circumstances. In this situation, a refund of all monies previously paid by the Client will be made, and the Photographer will endeavour to find a suitable replacement.

RIGHT TO A CREDIT
The Licence to Use requires that the Photographer’s name ‘Fergus Ford Photography’ will be printed on or in reasonable proximity to all published reproductions of the Photograph(s) e.g. press feature, online editorial feature.  The client is not required to include a credit next to images used on their own website, marketing literature or for personal use.  Crediting the photographer on social media platforms alongside images is not strictly required but is always appreciated.

REJECTION
There is no right to reject on the basis of style or composition.

MANIPULATION OF IMAGES
Manipulation of the image (including use of filter treatments) or use of a cropped portion of the image may only take place with the written permission of the Photographer.  It is requested that images are shared on social media without additional filters.  The photographer is always happy to liaise with any other creative professionals involved in the branding project to ensure best use of the images is made.

IMAGE STORAGE
Digital Data is stored by the Photographer on the understanding that the Photographer is not responsible for the future integrity of that data after delivery of final images, or of any failure to retrieve data from the Photographer’s archive.

APPLICABLE LAW
This agreement shall be governed by the Laws of England & Wales.

VARIATION
These Terms and Conditions shall not be varied except by agreement in writing
